has-vivid-red-color\">Kampala, Uganda <\/mark><\/strong>| <strong>The High Court has ruled that former Minister of Gender, Labour and Social Development Betty Amongi acted illegally and unlawfully when she terminated the employment of ministry official Osborn Turyasingura over allegations that he had used forged academic documents to secure his job.<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"375\" src=\"https:\/\/amolatarnewscast.com\/wp\/wp-content\/uploads\/2026\/09\/717417-1024x375.png\" alt=\"\" class=\"wp-image-1645\" srcset=\"https:\/\/amolatarnewscast.com\/wp\/wp-content\/uploads\/2026\/09\/717417-1024x375.png 1024w, https:\/\/amolatarnewscast.com\/wp\/wp-content\/uploads\/2026\/09\/717417-300x110.png 300w, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Justice <strong>Simon Peter Kinobe<\/strong> found that the decision to terminate Turyasingura was legally defective because he was not given an opportunity to respond to the allegations against him before the dismissal was made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling centres on the principle of <strong>procedural fairness<\/strong>, requiring public authorities and employers to give an affected employee a reasonable opportunity to know the allegations against them and defend themselves before an adverse decision is taken.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Turyasingura had challenged the decision to remove him from his position within the Special Interest Groups structure under the Ministry of Gender, Labour and Social Development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute arose after allegations emerged that he had presented forged academic documents in the process of obtaining employment. A report published in May 2026 alleged that Turyasingura had been dismissed after the ministry concluded that the academic papers he used to secure the position were forged. The report further stated that the ministry had initiated criminal proceedings over the alleged forgery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the High Court&#8217;s concern in the employment dispute was not simply whether the allegations were true. Instead, Justice Kinobe examined whether the authority responsible for the dismissal followed the law and afforded Turyasingura the procedural protections required before terminating his employment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge ruled that the termination was <strong>illegal and procedurally improper<\/strong>, holding that Turyasingura had not been accorded a fair opportunity to defend himself against the allegations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision underscores the distinction between an employer having grounds to investigate suspected misconduct and having the legal authority to immediately terminate an employee without following due process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In administrative and employment decisions, allegations of serious misconduct do not automatically remove an employee&#8217;s right to a fair hearing. An employer or public authority is expected to follow the prescribed disciplinary procedure before taking a decision that affects an individual&#8217;s employment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case therefore places emphasis on <strong>natural justice and the right to be heard<\/strong>, particularly where a public institution is taking disciplinary action against an employee.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">allegations of forged papers<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">The allegations against Turyasingura had previously attracted public attention after reports emerged that he had allegedly used forged academic documents to obtain his position.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the May 2026 report, the Special Interest Groups organ falls under the Ministry of Gender, Labour and Social Development, and Turyasingura had served as its Executive Secretary before his dismissal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The report also alleged that criminal charges relating to forgery had been opened against him. However, those allegations should be distinguished from the High Court&#8217;s finding on the legality of his termination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court&#8217;s ruling, as reported, does not amount to a finding that the academic documents were genuine. Rather, it addresses the manner in which the termination was carried out and whether Turyasingura was afforded the required opportunity to defend himself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment could have wider implications for disciplinary decisions within Uganda&#8217;s public service, where officials are required to act within the law when exercising administrative powers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It reinforces the principle that even where an institution believes an employee has committed serious misconduct, disciplinary action must comply with established procedures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case also highlights the importance of separating <strong>an allegation of misconduct, an administrative disciplinary decision and a criminal determination<\/strong>. A person facing an allegation of forgery is not automatically guilty simply because an employer believes the documents are fraudulent; the relevant legal and disciplinary processes must still be followed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling therefore represents a significant legal setback for the manner in which the termination was handled under the former minister&#8217;s administration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Kinobe remains a judge in the High Court&#8217;s Civil Division, according to the Judiciary&#8217;s August 2026 list of judicial officers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case involving Turyasingura and the Attorney General has consequently drawn attention to the limits of administrative power and the continuing
